Legal Malpractice
In situations involving IP legal malpractice, NERA has assessed damages to companies that flow from the claimed malpractice. Companies may claim failure to obtain a patent or to have lost patent protection because of certain alleged acts by the law firm handling its patent filings (e.g., if the law firm fails to make timely payments to the US Patent and Trademark Office).
