Fraudulent Conveyance Analysis in Lyondell Bankruptcy
A NERA team led by Senior Vice Presidents Dr. Faten Sabry and Dr. Ramsey Shehadeh was retained by LyondellBasell Industries (LBI) to conduct an independent evaluation of the findings filed by the plaintiff’s and defendants' experts in a fraudulent conveyance lawsuit. NERA's work aided LBI substantially in consensually resolving a major dispute in one of the most contentious recent Chapter 11 cases.
NERA's Role in Fishman Haygood Phelps Walmsley Willis & Swanson, LLP v. State Street Corporation, et al.
Dr. Robert Mackay, Senior Vice President and Chair of NERA Economic Consulting's Global Securities and Finance Practice, provided expert analysis on behalf of State Street Corporation in a recent case involving alleged violations of the Employee Retirement Income Security Act (ERISA). This case is noteworthy as it demonstrates that unrealized losses caused by mark-to-market values being below par do not automatically lead to investor injury.
