NERA Economists' Role in FTC v. Laboratory Corporation of America, et al.
LabCorp's acquisition of Westcliff Medical Laboratories in 2010 was the first transaction in which the US FTC went to court seeking a temporary restraining order and preliminary injunction since the 2010 Horizontal Merger Guidelines were issued. In February 2011, the Court issued an order denying the FTC's request for a preliminary injunction, extensively citing to NERA Senior Vice President Dr. Lawrence Wu's testimony and to the declaration filed by Dr. Wu and Senior Vice President Dr. Thomas McCarthy on behalf of LabCorp.
Fraudulent Conveyance Analysis in Lyondell Bankruptcy
A NERA team led by Senior Vice Presidents Dr. Faten Sabry and Dr. Ramsey Shehadeh was retained by LyondellBasell Industries (LBI) to conduct an independent evaluation of the findings filed by the plaintiff’s and defendants' experts in a fraudulent conveyance lawsuit. NERA's work aided LBI substantially in consensually resolving a major dispute in one of the most contentious recent Chapter 11 cases.
