American Airlines v. Google
The Situation
A key issue in advertising online has been the use of brand names as keywords in search engines such as Google and Yahoo. In the American Airlines v. Google case, American Airlines claimed trademark infringement by Google for selling its brand name to competitors whose advertisements showed up in the sponsored link section of search results when consumers conducted searches using American Airlines trademarks.
NERA's Role
NERA experts Dr. Kent D. Van Liere and Sarah Butler were retained by American Airlines to conduct surveys measuring the extent to which consumers were confused as to the source or endorsement of these sponsored links.
The Result
The case ultimately settled.
