The Situation

A major New York hotel was sued alleging gender discrimination in the hiring of servers.

NERA's Role

At trial, NERA testified that once the union-imposed hiring constraints the hotel operated under were taken into account, the statistical evidence did not support such an allegation and in fact was entirely consistent with a gender-neutral hiring process.

The Result

The jury returned a verdict for the defendant.
