The Situation
Following the refusal of the E.ON-Ruhrgas merger by the Bundeskartellamt, a NERA economist was solicited to submit an expert opinion on E.ON’s application for a ministerial permission (Antrag auf Ministererlaubnis).
NERA's Role
The NERA report evaluates E.ON's criticism of the Bundeskartellamt decision regarding the anticipated effect of the merger on competition in the German energy sector, evaluates the public interest arguments brought forward by E.ON and discusses the concrete merger conditions which would have to be put in place to ensure a competitive German energy market after the merger.
The Result
The report is part of the official documentation in this merger case and has been substantially cited by the monopolies commission (Monopolkommission) in its refusal of the merger.
