Article 82 and State Aid: an Economic Agenda for Reform

Following a comprehensive reform process in the areas of potentially anti-competitive agreements (i.e., article 81) and of merger control, the European Commission has now shifted its focus toward the modernization of abuse-of-dominance provisions (i.e., article 82) and state aid. As with the reform packages for article 81 and for merger control, the increasing influence of economic analysis is also a key feature of the review of article 82 and of the rules on state aid.
