La clemencia en la lucha contra los cárteles (Leniency and the fight against cartels)

In early 2006, the Spanish Government made public a draft version of the new Competition Act, which, if approved, would involve major reforms of the current antitrust regime in Spain. NERA Associate Director Fernando Jiménez comments on the proposed reforms in a special edition of competition policy journal Gaceta Jurídica. In his article, Mr. Jiménez analyzes the proposal to establish a leniency program granting immunity from fines to cartel members that inform the competition authority of the existence of collusive agreements between competitors. He also identifies key elements in the design of successful leniency programs and reviews the international experience in Europe and the US. The article concludes with recommendations to improve the effectiveness of the Spanish proposal.
