The law governing class actions in Italy came into force on 1 January 2010. The class action provision allows consumers to bring legal action for damages deriving from breach of contract, product liability, unfair trade practices, or anticompetitive conduct. Under the new provision, a class action is declared inadmissible when a claim is determined to be unfounded; when there is conflict of interest between members of the proposed class; when there is no identity of rights of members of the class protected by the proposed class action; or when the proposer cannot adequately protect the interests of the proposed class. If the class action is declared admissible, a second phase of the process establishes whether there is liability -- and damages. Economic analysis is an essential tool in cases of class action.
