In an increasing number of recent merger decisions, the Australian Competition and Consumer Commission (ACCC) has cited the potential for "coordinated effects" to give rise to a substantial lessening of competition. Coordinated effects involve firms acting in concert so as to increase profits. This NERA colloquium -- held in our Sydney office on 13 October 2010 and in our Melbourne office on 14 October -- presented economic and legal perspectives on the growing prominence of coordinated effects in clearance assessments and what this means for firms and their advisors.
