Business Migrations: Economic Insight and Lessons for Europe in Light of the German Experience

Germany hosts a number of multinational enterprises that are conducting an increasing amount of cross-border migrations of business functions. New German legislation concentrates on the profit potential of the transfer package associated with the migration. Business migration issues are also at the center of intense discussions between taxpayers and tax authorities in many other countries throughout Europe, as well as within supranational bodies such as the OECD. NERA's Brussels office hosted this European-American Tax Institute roundtable on 10 January 2008 to examine the economic techniques for ascertaining arm's length valuations of the business migration package and to draw lessons for Europe in light of the new German legislation. NERA Special Consultants Pim Fris and Dr. Alexander Voegele and Associate Director Jean-Sébastien Lénik chaired the discussion.
