Seminar on China's Antimonopoly Law and Regulation on Abuse of Intellectual Property Rights

China's Antimonopoly Law, which will go into effect on 1 August 2008, includes explicit provisions to prohibit the abuse of intellectual property rights (IPR). To examine the impact of IPR enforcement on competition policy in China and how it will affect the global IP strategies of multinational corporations, the China Society for World Trade Organization Studies, an economic and trade research association under the Ministry of Commerce of the People's Republic of China (MOFCOM), hosted this conference in Beijing on 26-27 April 2008. As part of the conference, NERA Senior Vice President Dr. Alan Cox delivered opening remarks and also presented "Dealing with Antitrust Problems in Standard Setting." Dr. Cox's presentation addressed antitrust problems that have occurred during the setting of standards, and the solutions that standard setting organizations have developed. In addition, Senior Consultant Dr. Fei Deng delivered a presentation entitled "Antitrust Issues with Intellectual Property Rights." Dr. Deng discussed the types of antitrust issues that arise specifically with IPR, such as unilateral refusal to license, standard-setting, and tying and bundling. Vice President Dr. Gregory Leonard also participated.
