The Fédération Internationale des Conseils en Propriété Industrielle held its World Congress in Washington, DC on 6-10 June 2009 to examine the continuing role of intellectual property rights in a global economy. On 7 June, NERA Special Consultant Dr. Richard Rozek participated in a session entitled "Are Patents Worth the Cost of Obtaining Them?" along with Professor Michael J. Meurer of the Boston University School of Law. Dr. Rozek and Professor Meurer discussed the cost of litigating patents versus the potential rewards, and the additional benefits of patenting not captured by a strict damages approach in litigation. Namely, the existence of patents often means that no litigation occurs since the patents are licensed individually or as a part of a standards-setting organization, and patents may be especially valuable in facilitating entry into markets by small companies and individual inventors.
