As high-stakes, complex securities cases continue to grow, the need to stay updated on the latest case law, enforcement initiatives, emerging trends, and breaking developments grows even more important. To address this need, the Practising Law Institute held its annual securities litigation and enforcement program in San Francisco on 15-16 October 2007. The program addressed a range of timely topics, including recent Supreme Court cases on scienter and scheme liability; the latest government enforcement initiatives; developments in internal investigations; settlement strategies; and ethical issues for securities lawyers. Senior Vice President Dr. Marcia Kramer Mayer delivered a presentation on the measure of Rule 10b-5 damages, explaining how the out-of-pocket (inflation-based) rule is limited by offsets, PSLRA's Bounceback Rule (applied to all disclosures, not just the last), and the US Supreme Court's decision in Dura Pharmaceuticals v. Brouda.
