The Role of D&O Insurance in the Settlement of Securities Class Actions

New York, New York
16 November 2007
Hosted By: the Fordham Corporate Law Center

NERA Senior Vice President Dr. Marcia Kramer Mayer participated in a roundtable discussion at Fordham Law School in New York City on 16 November 2007. The invitation-only event brought together plaintiffs' counsel, defense counsel, insurance company attorneys and their outside counsel, law professors, and other industry experts to discuss the role that directors' and officers' insurance plays in the settlement of securities class actions. The discussion focused on a draft paper by conference organizers and Fordham Law professors Tom Baker and Sean Griffith, "How the Merits Matter: D&O Insurance and Settlements in Securities Class Actions." The program began with Dr. Mayer delivering a presentation on trends in filings and settlements, and NERA's findings about the factors predictive of settlement size.
