Experience
Dr. Butler is a George Mason University Foundation Professor of Law, and serves as Executive Director of the George Mason University Law & Economics Center. His research and teachings focus on issues related to antitrust, contracting, health care, corporate governance, consumer protection, banking, insurance, environmental law and policy, and securities regulation. For over 20 years, he has managed judicial education programs that teach judges the basics of economics, finance, accounting, statistics, and scientific methods. Over 4,000 sitting federal and state judges have attended programs under Dr. Butler's direction.
Dr. Butler has been affiliated with NERA since 2007. He periodically serves as an expert witness in state and federal court proceedings, often to offer rebuttal testimony as to whether economic methodologies have been relied upon in an inappropriate or inconsistent manner and, if so, whether such analyses have led to misleading conclusions. He has testified on a variety of issues, including Daubert challenges, intellectual property antitrust counterclaims, damages from breach of contract, antitrust (e.g., conspiracy, bid-rigging, not-for-profit conversion), and class certification in wage and hour disputes. These cases involved a variety of industries, including aerospace, airlines, commercial real estate leases, grocery products, health insurance, hospital services, infant formula, mass merchandise, and surgical instruments.
Prior to joining George Mason University, Dr. Butler taught at the Northwestern University School of Law, where he also served as Executive Director of the Searle Center on Law, Regulation, and Economic Growth. Before that, he was the James Farley Professor of Economics in the George L. Argyros School of Business and Economics and a professor of law at Chapman University, and the Fred C. and Mary R. Koch Distinguished Professor of Law and Economics at the University of Kansas.
Dr. Butler has written extensively on a number of topics, including the economics of contracting, antitrust and competition, corporate governance, and consumer protection. In addition to several books, Dr. Butler has published in leading economic journals including the Journal of Law & Economics, the Journal of Legal Studies, and the Journal of Law, Economics, and Organization. He has published in many major law reviews, including the Virginia Law Review, Cornell Law Review, and Yale Journal on Regulation. Dr. Butler's casebook, Economic Analysis for Lawyers, has been adopted at leading law schools and is the primary textbook for the Economics Institutes for Judges.
Dr. Butler received his PhD and MA in economics from Virginia Polytechnic Institute and State University, and his JD from the University of Miami School of Law.
