Experience

Mr. Matthew is an Associate Director at NERA with over 15 years' experience in the economics of competition policy and regulation, both in the private and public sector. From 1993 to 1999, Mr. Matthew was a Senior Economist at the UK Office of Fair Trading (OFT), during which time he advised on several hundred competition and merger cases spanning a wide range of markets. From 1999 to 2003, immediately prior to joining NERA, Mr. Matthew was Head of Economic Regulation and Competition Policy at the UK Civil Aviation Authority (CAA).

Mr. Matthew is a leading expert on competition and regulatory matters in the aviation sector. During his time at the CAA, his work involved analysis of the full range of competition and regulatory issues. He led the price cap regulatory reviews of BAA plc and NATS Ltd and matters involving airports, airlines, ground handling, surface access, and air traffic control. Since joining NERA he has advised on competition policy and regulatory issues in the airport sector in the EU, Austria, Hungary, Ireland, Slovakia, and the UK, including the market investigation into BAA and competition litigation in connection with airport fuel charges and other disputes.

He also has extensive expertise in the sport and media sectors. During his time at the OFT he was the primary author of the Director General's Review of Pay TV (1996), and FA Premier League (1999). Since joining NERA he has worked on a range of matters in the media and sports sectors, including the Carlton/Granada ITV merger for ISBA (leading to the Contract Rights Renewal price cap remedy), the Ofcom enquiry into Pay TV, and the Ofcom Competition Act investigation of FA Cup Radio Rights. He also advised the UK Competition Commission in its analysis of Classified Directory Advertising Services.

In addition to cases before the UK OFT and Competition Commission, Mr. Matthew has submitted expert reports in litigation cases before the High Court, the Competition Appeal Tribunal (CAT), and international arbitration tribunals such as the ICC. His experience includes competition litigation in the media and aviation sectors, the National Grid (gas meters) case, as well as the intellectual property damages cases Coflexip SA v. Stolt Offshore Ltd (flexible oil piping) and Servier v. Apotex Inc (generic pharmaceuticals). Mr. Matthew has been cross-examined as an expert witness on several occasions.

Mr. Matthew also has significant expertise in the application of competition policy in the fields of state aid (where he co-authored the report Case Studies of Public Subsidies in the UK for the OFT), at the intersection of antitrust and regulation, and in competition policy applied within the public sector, international trade policy, and emerging competition regimes, including Singapore and India. In the course of his career, Mr. Matthew's work has spanned a wide range of industries, such as pharmaceuticals, publishing, newspapers, cinemas, movie studios, bananas, gambling, cement and building materials, retailing, post offices, video games, travel agencies, rail and bus services, defense, agriculture, legal services, estate agents, energy, water, telecoms, and the Internet.

Mr. Matthew was educated at Edinburgh University, where he obtained an MA in economics and economic history (First Class), and at Oxford University, where he obtained an MPhil in economics.
