Experience
Mr. Pabon-Agudelo is a Vice President in NERA's Energy, Environment, and Network Industries Practice, specializing in issues of energy regulation and restructuring, privatization, market design, and economic analysis, with consulting experience in litigation. He has worked broadly with governments, state-owned utilities, and corporations in Latin America, South Asia, Africa, and the US. He has also led efforts to assess strategic alternatives for utilities and Independent Power Producers (IPPs) in Latin America, Central Europe, North Africa, and the US.
In Latin America and especially Brazil, Mr. Pabon has worked extensively for private companies, as well as for electricity regulatory agencies and system operators. He has considerable experience with regulatory issues related to the distribution and generation businesses. He has also participated in projects sponsored by governments and multilateral agencies on the development of energy policies and energy strategies, market design, privatization, and regulatory analysis in the electricity and natural gas sectors in Latin America and Central Europe. In addition, Mr. Pabon has worked on the design and operation of independent regulatory commissions in India and Brazil.
Mr. Pabon has marked experience in the development of tariff policies at the distribution and transmission levels, as well as with the analysis of tariff issues, estimations of the cost of capital, implementation of institutional strengthening plans, and risk management. In addition, he has analyzed the market design and implementation problems that have discouraged private investment in electricity sectors (e.g., Brazil and India) and has advised investors on the analysis and implementation of new regulatory models, including advice on auction processes for energy procurement. A key focus of his recent work has been the development of commercial and regulatory strategies for IPPs and utilities for the Latin American continent.
Mr. Pabon provides litigation consulting expertise in liabilities and damages in a variety of international arbitrations in infrastructure industries and in cases involving economic utility decision-making, breach of confidentiality, contracting, market interaction, and contract disputes for governments and private investors from Latin America, Europe, and South Asia.
In the US, Mr. Pabon has evaluated the strategic alternatives for utilities in the era of deregulation. He has modeled the US power market and has performed quantitative analyses to assess the technical alternatives available to US utilities seeking to increase the competitiveness of their power plants in the context of new marketing and financial mechanisms.
Prior to joining NERA, Mr. Pabon advised the Colombian Minister of Finance on regulatory framework issues and represented the Ministry before the Energy Regulatory Commission. He also served as Chief of the Planning, Evaluation, and Negotiation Department at Carbocol, a state-owned coal company in Colombia.
