NERA economists provide a wide range of services in the employment and labor field and have long been recognized as leaders and innovators in the area. Specifically, NERA's expertise extends to:

Statistical analysis of class action claims of employment discrimination, at certification and in subsequent phases. Our focus is on presenting statistical analyses that accurately model the challenged decision process without jargon, and explain the results in simple, comprehensible terms. NERA economists and statisticians have analyzed class claims of hiring, compensation, promotion, termination, and performance rating discrimination, as well as pattern and practice claims for smaller groups of plaintiffs.

Evaluation of claims of economic loss, both in individual and class claims. Though a generic evaluation of damages may seem impressive, NERA tells the story of the economic loss through careful evaluation of the facts of the case and the compensation and promotion systems in place at the defendant. This approach allows for straightforward explanation of losses without appeal to wide-ranging statistics or mathematical models of limited or no relevance.

Contracting Affirmative Action. NERA is the nation's leading expert in the evaluation of MBE/DBE programs. Our studies have withstood judicial scrutiny and have been used to create and uphold lawful affirmative action plans for obtaining goods and services from firms owned by minorities and women. Only NERA's methodology has been found to meet the constitutional requirements for race and gender conscious programs at trial and on appeal.

Evaluation of wage and hour claims, and the associated damages. NERA's expertise in managing large data sets and producing clear and concise results allows us to accurately value exposure in these cases. Through careful analysis of alleged violations and their implications, NERA is able to present an evaluation of claims that shows both sides the dollar amount at issue.

Workforce Reviews. NERA applies the same rigorous standards to evaluating whether any statistical disparity exists in employment outcomes, such as pay or promotion. Our extensive experience in employment litigation allows us to accurately model the process in question to identify areas which merit further inquiry and to anticipate types of analyses typically proffered in litigation that might erroneously point to other areas. Only through examining both of these types of analyses can companies understand their exposure. NERA's economists not only perform these analyses but work with the client to identify solutions.

Union-related Analyses. NERA economists have testified before various impasse panels on the advisability of wage increases for employees in industries ranging from transportation to security to education.
