Antitrust and Unfair Competition Developments Forum -- Unilateral Conduct

Paul Hofer, an Associate Director in NERA's London, Brussels, and Frankfurt offices, spoke at the AIJA and UIA Antitrust and Unfair Competition Developments Forum, held in Brussels on 24-25 April 2009. Mr. Hofer discussed the economics of exclusionary abuse on a panel dealing with unilateral conduct.
In addition to providing an overview of the various traditional types of exclusionary abuse (including predation, tying and bundling, exclusive dealing, and margin squeeze), Mr. Hofer discussed novel theories of harm, the economic significance of recoupment, the role of dominance in the context of Article 82, and the estimation of damages in exclusionary abuse cases.
The Forum's program also included sessions on leniency and private enforcement, vertical relationships, and the interface between intellectual property law and antitrust enforcement.
