As commerce between the US and Canada continues to grow, cross-border legal issues are becoming a daily concern for in-house counsel on both sides of the border. This Benchmark Canada forum, held in New York City on 27 September 2012, brought together US and Canadian experts to discuss the latest key trends, developments, and best practices in Canadian litigation. NERA Senior Vice President Dr. Vinita Juneja and Associate Director Robert Patton led a panel discussion entitled "The Economic Expert's Role in Class Certification and Economic Damages Issues in Cross-Border Securities Litigation." Based on their experience in numerous Canadian and US-Canada cross-border matters, Dr. Juneja and Mr. Patton discussed trends in Canadian and cross-border US-Canada securities fraud litigation; issues in class certification, including the differences in Canada and the US and the role of expert evidence; and economic damages exposure in US, Canadian, and cross-border securities litigation.
