Addressing the Risks of Class Certification

Palo Alto, CA
24 August 2016
Hosted By: NERA Economic Consulting

Litigation over class certification poses huge risks to both plaintiffs and defendants.  Class certification, if granted, will dramatically increase the leverage that plaintiffs have in settlement discussions, while exposing defendants to the often huge potential liabilities of a jury trial over claims made on behalf of potentially tens of thousands of claimants.

Please join speakers from Google, Morrison & Foerster, and NERA for a panel discussion on the management and strategy of class certification claims from the perspective of in-house counsel, an experienced class-action litigator, and an economist.

Topics will include:

  • The development of strategies in light of recent court decisions, including Comcast, Plastic Additives and Walmart Stores;
  • Managing a class certification case, including dealing with publicity, reputational concerns, and discovery;
  • Economic tools, including surveys and regression techniques, which can be used in defending or undercutting certification; and
  • Data on the number of successful class certification appeals and some examples of analysis that has been successfully applied in class certification matters.
