The Antitrust Section Mergers Committee of the New York State Bar Association is hosting a retrospective analysis of the year-long Dollar Tree/Family Dollar/Dollar General merger transaction. Dr. Timothy Watts will join an attorney from Wachtell, Lipton, Rosen & Katz to discuss his role in the matter, which involved an innovative application of the Gross Upward Pricing Pressure Index, or GUPPI, to a retail merger. In a public statement issued in 2015, FTC Commissioner Joshua Wright described the analyses performed by NERA and the FTC’s economists as “important initial steps in applying more sophisticated economic tools in conducting merger analysis.”
