NERA Managing Director Dr. Alan Cox and Director Richard Eichmann will lead a panel on “Apportioning Damages in Patent Cases” at a seminar hosted by the Silicon Valley Chapter of the Licensing Executives Society.

Dr. Cox, Mr. Eichmann, and Michael Zachary, a partner at Andrews Kurth Kenyon, will discuss “apportionment,” a key issue affecting patent damages calculations. During the seminar, they will provide a summary of recent cases and discuss methods and inputs for determining a patent’s value, including the use and abuse of surveys, the relevance of prior licensing and settlement agreements, forward citations of the patent at issue, and other methods of determining value.
