Associate Director Dominik Huebler will speak at a webinar entitled “Sind Daten das neue Diesel” (Are Data the New Diesel Cars) exploring perspectives for data privacy-related class actions under Art. 82 EU GDPR on 1 December 2020 at 10:00 am CET. Mr. Huebler and other speakers will discuss whether new rules for class actions and the EU General Data Protection Regulation (GDPR) will result in a wave of litigation similar to that faced by Volkswagen over its diesel emissions marketing. The panelists will cover:

  • Damages concepts, preconditions for claims, and burden of proof;
  • Recent precedent on Art. 82 GDPR damages awarded;
  • Economic approaches to estimating the level of damages; and
  • Applications of the damages concepts to other cases (e.g., fines according to Art. 83 GDPR and compliance issues).
