Global Arbitration Review’s The Guide to Damages in International Arbitration is a desktop reference guide for arbitration practitioners seeking a high-level overview of damages, including related legal principles, procedural issues, valuation techniques for assessing and quantifying damages, and industry-specific considerations.

Dr. Chudozie Okongwu, Managing Director and Head of NERA’s European Finance, Litigation, and Dispute Resolution Group, authored the chapter entitled “Damages in Financial Services Arbitrations,” with assistance from NERA Associate Director Erin McHugh. Estimating damages in financial services disputes often involves the valuation of complex financial instruments. Dr. Okongwu’s chapter explains general valuation concepts applicable to all financial instruments, as well as more complex concepts that are particularly important when valuing derivatives. The chapter also provides examples of how changes in financial regulation can affect the valuation of financial products.
