The ABA Section of Labor and Employment Law held its fourth annual conference in Chicago on 3-6 November 2010. Dr. Denise Neumann Martin, Senior Vice President and Chair of NERA's Employment and Labor Practice, participated in a panel session entitled "Get in the Game: The Latest News and Developments in Wage and Hour Litigation." The dramatic growth of multiple plaintiff and class action lawsuits under federal and state laws has made wage and hour litigation a hot topic for employment lawyers and created an increasing demand for lawyers familiar with the procedural and substantive issues that arise in these cases. This panel provided guidance for handling the fundamental aspects of this type of litigation, and highlighted the latest issues governing hours of work and payment of wages, including exemptions from overtime, employee misclassifications, and the compensability of hours worked.
