5G and related developments are in the news almost every day. Like the rollout of prior telecom network standards, 5G involves the development of standards by numerous standard-setting organizations and thousands of patents that claim to be standard and essential. Unlike the rollout of prior telecom network standards, however, 5G’s impact extends well beyond telecom and could impact everything from video conferencing to self-driving cars and remote surgery.

In this free, one-hour webinar, held on 19 November, at 12:00–1:00 pm EST, Director Kristopher Boushie and Ropes & Gray Partner Matthew Rizzolo and Counsel Dr. Samuel Brenner will:

  • Explore some of the unique licensing challenges resulting from the use of 5G, including determining fair, reasonable, and non-discriminatory (F/RAND) rates for a wide variety of licensees who might implement 5G technology in drastically different ways;
  • Review important F/RAND decisions, the applicability to 5G licensing, and methodologies used to determine F/RAND rates; and
  • Discuss recent cases such as Unwired Planet v. Huawei, Godo Kaisha IP Bridge v. TCL, Microsoft v. Motorola, and Sisvel International S.A. v. Haier Deutschland GmbH.

Kristopher Boushie is a Director in NERA’s Intellectual Property Practice. He has more than 30 years of experience in financial and litigation consulting, with an emphasis on forensic valuation issues, and more than 25 years of experience in intellectual property matters. His expertise includes analyzing and quantifying damages in intellectual property infringement, contract disputes, distributorship terminations, antitrust, and tort claims. Mr. Boushie consults with clients on intellectual property valuations, intellectual asset management, royalty auditing, and other financial and cost accounting-related issues in areas such as cost assignment and allocation, data cost compensation, and forensic accounting. He is often retained as a testifying expert and has testified in arbitration hearings, state court, US district court, and the European Commission.

Matthew Rizzolo is a litigator who works extensively with technology companies to both enforce clients’ intellectual property rights and defend clients from infringement claims. Mr. Rizzolo has significant experience litigating patent cases in a variety of jurisdictions, including federal district courts throughout the United States, the Court of Federal Claims, and in Section 337 actions before the United States International Trade Commission. His practice encompasses all facets of litigation, from pre-suit investigation through trial, post-trial proceedings, and appeals. Mr. Rizzolo has counseled clients in cases involving a wide variety of technical fields, including smartphones, video gaming devices, computer software and hardware, telecommunications, and internet-related services, as well as biotechnology and pharmaceuticals. He has additional experience in drafting and negotiating patent and technology licensing agreements, and is registered to practice before the US Patent & Trademark Office.

Dr. Samuel Brenner is counsel practicing in Ropes & Gray’s intellectual property group, focusing primarily on patent litigation. Dr. Brenner is an experienced trial lawyer who has litigated patent cases in district court and the United States International Trade Commission on behalf of companies in a variety of technical fields, including telecommunications, electronics, software and hardware, and semiconductors. He has significant experience counseling clients in matters involving litigation and licensing strategy. His practice encompasses all facets of litigation, from pre-suit investigation through formulating litigation strategy, managing discovery, taking and defending fact and expert depositions, claim construction proceedings, motion practice, trial preparation, trial, and appeals. Dr. Brenner is also experienced with patent damages, Standard Essential Patents, and RAND/FRAND issues.
