Insurance Markets and Competition

Insurance markets and competition reflect the industry’s unique regulatory environment as well as supplier, buyer, and product characteristics. Insurance mergers and acquisitions must receive regulatory approval from state insurance departments in addition to receiving oversight from the Department of Justice and the Federal Trade Commission. Historically, litigation relating to insurance competition has involved claims of price fixing and cooperation among insurers, allegations of improper marketing and disclosure, coverage disputes, and allegations of underpayment to service providers.
