Claim File Sampling and Analysis

It is often the case in product liability and mass tort cases that relevant data are available in paper files only. Proper analysis of these data may require that it first be manually coded to convert the information into an electronic database.
 
NERA has extensive experience with coding of this type. Our experts have mastered all aspects of capturing, coding, and organizing information from claims files to generate electronic databases. This process begins with the development of a coding protocol that establishes clear rules (avoiding error or bias introduced by human subjectivity), and a system of double-entry and reconciliation to ensure accuracy. We manage teams of coders, operating round-the-clock shifts (if necessary) to ensure the project is completed in a timely and efficient manner.
 
We have coded large samples of personal injury and property damage claims in a number of areas, including asbestos, breast implants, medical devices, food poisoning, and police incidence reports. Depending on the type of information to be entered or source file used, we ensure that the claim coders have the requisite skills to accurately code the information. For example, we have used paralegals to code claimant depositions and health professionals to code medical files.

We use rigorous sampling and statistical techniques to determine whether a sample is representative of the population and have testified about sampling methodologies. Our statistical analyses of claim files have been used in insurance coverage disputes, bankruptcy actions and settlement negotiations.
