Senate Testimony on Pay-for-Delay Deals

On 23 July 2013, NERA Senior Vice President Dr. Sumanth Addanki delivered testimony before the Subcommittee on Antitrust, Competition Policy and Consumer Rights of the US Senate on so-called Pay-for-Delay deals and the context of proposed legislation S214.

In his testimony, Dr. Addanki suggested that S214 in its current form needs to be modified in several respects if it is to lead to the right economic outcomes. In particular, the bill needs to acknowledge the importance of the monopoly power screen and give due weight to that screen in the analysis of any settlement.
