By the end of 2020, Facebook faced two government-led antitrust challenges and four private class action lawsuits. NERA Consultant Dr. Max Perez Leon has written a comparative summary of the antitrust complaints filed against Facebook by the FTC, State AGs, and Sherman and Klein class plaintiffs, who claim Facebook has illegally monopolized the markets for social networks.

Economic issues such as the presence of zero-prices, network effects, and privacy/quality concerns are critical and will need to be resolved by antitrust practitioners as the cases develop. In his article, Dr. Perez Leon provides a summary of the government-led complaints and the class actions regarding their allegations linked to relevant markets, market power, entry barriers, anticompetitive behavior, and theories of harm.
