The Role of Contract Structure for Damage Quantification: Pitfalls and Solutions

In a new article for the European Competition Journal, Consultant Robert Lauer discusses the role of contract structure for damage quantification. While in practice the economic analysis is often carried out on the assumption of a linear pricing structure, more complicated contract structures have largely been ignored in the applied antitrust damages literature. This paper aims to fill this gap, by discussing implications of tariff structure for damage quantification, highlighting common pitfalls, and proposing practical solutions in damage assessment when two-part tariffs are present.
