On 19 June, NERA Director Kevin Counsell participated in the panel discussion “Moving Forward—Dealing with the Commerce Commission’s Changing Approach” during the Competition Law and Regulation in New Zealand conference. He discussed strategies for businesses, lawyers, and economists to navigate the evolving competition landscape, addressing key areas such as cartel criminalization, the effect-test in section 36 of the Commerce Act, market studies, and specific regulations pertaining to fuel and groceries. With an emphasis on the dynamic nature of markets and evolving merger enforcement overseas, Mr. Counsell highlighted the need for practitioners to review business practices, provide guidance, engage stakeholders, and effectively communicate the amendments to ensure compliance and mitigate uncertainty.
