Technical standards and patent pools continue to be extremely important in the electronics, software, and other high technology industries. With this in mind, government regulators, legal practitioners, and industry participants convened at this third annual conference in Arlington, Virginia on 11-12 October 2007. They discussed the process of establishing technical standards and patent pools and issues surrounding licensing both individual patents and pools of patents that are necessary to practice these standards. The program provided real-world examples involving the Moving Pictures Expert Group (MPEG), the Broadcom v. Qualcomm case, and recent DOJ business review letters, among others. NERA Senior Vice President Dr. Alan Cox delivered a presentation, entitled "Tips for Determining 'Reasonable' Royalties," with Gil Ohana of Wilmer Cutler Pickering Hale and Dorr LLP. Dr. Cox and Mr. Ohana discussed the impact of recent case law on the economic analysis of determining a reasonable royalty and the practical impact of this case law on licensing negotiations. Judge Randall Rader of the Court of Appeals for the Federal Circuit also addressed the meeting.
