NERA Vice President Dr. Sharon Brown-Hruska delivered a presentation, "Manipulation of Energy Markets: Jurisdiction and Regulatory Compliance," before the Energy Committee of the Association of the Bar of the City of New York on 8 January 2008. Dr. Brown-Hruska discussed how new theories of market manipulation and expanded assertions of jurisdiction have increased regulatory and legal risks for firms involved in trading in exchange-traded futures and options, over-the-counter (OTC) derivatives, and physical markets. She suggested that the legal standards for proving manipulation are fundamentally economic in nature and will present a risk-focused compliance protocol that could help firms and their legal and compliance professionals respond proactively to the new regulatory environment. Dr. Brown-Hruska also discussed The CFTC & FERC vs Amaranth: Doing the Sister Regulator Act, an article she co-authored with Robert Zwirb of Cadwaladar, Wickersham, and Taft that appeared in the Futures and Derivatives Law Report.
