Several recent rulings by the US Supreme Court and Court of Appeals for the Federal Circuit influence the value of patents and the manner in which patent infringement damages are calculated. Some proposals for patent reform raise further issues in damages calculation. While these changes in the law and economics of patents are taking place, many practitioners pay inadequate attention to the manner in which damages are calculated. Furthermore, damage estimates sometimes have insufficient methodological basis or are presented to the jury without adequate thought given to the exposition. To address these issues, Law Seminars International held this conference in San Francisco on 20 April 2009. NERA Senior Vice President Dr. Alan Cox served as Program Co-Chair and presented an introduction and program overview.
