NERA Senior Vice President Dr. Alan Cox participated in a one-hour webinar panel hosted by the Intellectual Property Owners Association IPChat channel on 1 April 2010. Damage awards in trade secrets matters have reached as high as $192 million, in part as a result of the availability of unjust enrichment. The panelists covered many of the issues that arise in trade secrets litigation, including damages calculations and strategies for winning and enforcing injunctions. Dr. Cox described some lost profits and unjust enrichment calculations and other remedies in trade secrets litigation from recent cases. He was joined by fellow panelists Victoria Cundiff, Esq. of Paul Hastings and R. Mark Halligan, Esq. of Nixon Peabody.
