On 16 October, NERA Managing Director Robert Patton will speak in a session titled “De-Risking Risk: How Experts Evaluate Unforeseen Risks” at CanArbWeek 2023. Mr. Patton will explore four factors impacting the evaluation of unforeseen risks in damages quantification and valuation:

• Date of breach vs. date of assessment;
• How to address unforeseen circumstances not covered in the contract;
• Reliance on subject matter experts; and
• How to isolate the effect of breach from the effect of other events.
