NERA Senior Vice President Dr. Christine Siegwarth Meyer co-chaired Calculating & Proving Patent Damages, a Law Seminars International program held in Washington, DC on 18-19 September 2014. Dr. Meyer and her program co-chair, Gary M. Rubman of Covington & Burling, opened the conference with an overview of the current state of the law with respect to governing patent damages calculation. Dr. Meyer also participated in a session entitled "Pharmaceutical Litigation: Hatch Waxman and Damages in the Context of an At Risk Launch," which examined unique aspects to these cases and their impact on patent damages. In addition, NERA Vice President Dr. David Blackburn joined Mr. Rubman for a session entitled "How to Construct the Hypothetical Negotiation in Light of Recent Law." Dr. Blackburn and Mr. Rubman discussed the requirements for demonstrating comparability since the ResQNet decision, as well as the current role of the "Book of Wisdom" concept in calculating damages.
