NERA Vice President Sarah Butler participated in a two-hour Knowledge Group webcast that addressed the use of surveys in trademark litigation. Surveys have been identified as a significant tool in knowing how the purchasing public perceives a mark, and is an effective tool in helping attorneys navigate trademark cases faced by their companies and clients. Ms. Butler, an expert on survey research and analysis related to trademarks, patents, and false advertising including surveys to establish likelihood of confusion, secondary meaning, and dilution, was joined on the panel by John S. McKeown, Counsel at Goldman Sloan Nash & Haber LLP; Brendan O'Rourke, Partner at Proskauer Rose LLP; and Bradley Walz, Shareholder at Winthrop & Weinstine.
