NERA held its Fifth Annual Financial Litigation, Disputes, and Enforcement Seminar in London, UK on 14 October 2015. During the event, former regulators, in-house counsel, litigators, and economists examined recent developments and discussed what disputes are emerging as the wave of post-financial crisis litigation and enforcement subsides. The event included a keynote session on financial regulatory enforcement and panel discussions on emerging trends in financial disputes and enforcements, followed by a drinks reception.

Program topics included:

  • A transatlantic conversation about regulation and enforcement: How the relationship between financial services firms and regulators has changed since the global financial crisis; what is the appropriate balance between vigorously pursuing wrongdoing on the one hand and encouraging innovation and a thriving financial sector on the other?

  • The next frontier in banking and finance investigations: Emerging trends and tools in regulatory and internal investigations, including those relating to interbank lending rates, foreign exchange, commodities, and other benchmarks.

  • Investor group actions and other post-crisis trends in financial litigation and enforcement in the UK/EU: Where are the next disputes coming from?
  • "Speed briefing" sessions in the areas of market abuse in energy markets, the analytical and legal challenges presented by big data, and the law and economics of bitcoin and other virtual currencies.
