Amidst a seeming outbreak of high-profile data breaches in 2014 and 2015, privacy-related litigation covering both data breaches and the collection and sharing of personal information has been on the rise. In this rapidly evolving data privacy legal and regulatory environment, companies and their legal counsel need a good understanding of the regulatory climate, legal framework and practice, and the size of their potential exposure in order to make sound decisions.

This NERA breakfast and panel discussion will feature legal and economic experts from the Federal Trade Commission (FTC), Baker & Hostetler, Morrison & Foerster, and NERA. Darren Lubetzky, FTC staff attorney for the Northeast Region, will discuss current FTC enforcement priorities and key factors in evaluating potential cases for enforcement. He will also explore the FTC's priorities in the near term. The program will also cover the current state of the law by providing an overview of data breach, data collection, and data sharing legal, economic, and regulatory issues and feature insights from experts' case experiences. The panel will discuss settlement practices and trends for privacy and data breach cases and present approaches for quantifying the size of potential exposure in these cases.
