In an attempt to satisfy the hurdle set in Comcast v. Behrend, plaintiffs in consumer class action litigation have begun to propose the application of complex survey and statistical tools. In this seminar, Paul Gale, Esq. of Troutman Sanders and NERA experts Dr. Denise Martin and Dr. Kent Van Liere will explain several of these tools, the legal implications of their use, and how the team was able to convince the court to reject class certification in the recent In re NJOY, Inc. matter.
