Sloan sued Zurn, accusing it of infringing upon its patent for a toilet flushing mechanism. To estimate damages, Sloan experts selected a sample of toilets in certain buildings and collected information about other plumbing equipment found in the same bathrooms.
NERA statisticians were hired to evaluate the sampling plan and the conclusions drawn from the data collected on the basis of this plan.
Reports have been submitted to the Court and the trial is scheduled for 2014
