Philip de Homont served as an appointed quantum expert in an arbitration between a multinational industrial company (claimant) and a warehouse and logistics provider (respondent). The dispute focused on the calculation of damages resulting from the provider’s failure to consistently achieve agreed-upon delivery targets under a long-term warehousing contract.

As a neutral and independent expert, Mr. de Homont was tasked with quantifying alleged damages put forward by the claimant. This included preparing a quantum expert report for the claimant’s Statement of Claim and additional supplemental reports addressing points raised in the respondent’s rejoinder.

His analysis included:

  • Calculating liquidated damages through a comprehensive review and consolidation of operational data from both parties. He modelled variations in delivery performance, resolved data gaps and fragmentation, and developed a transparent, robust damages calculation model. He worked closely with the claimant and legal teams to clarify data sources and validate assumptions.
  • Assessing incremental losses and mitigation costs incurred to address service failures, such as securing alternative warehousing and logistics capacity. Each category of loss was substantiated by detailed invoice mapping, with deep dives for the most material claims supported by interviews and corroborating documentation.

Mr. de Homont’s independent quantum expert report offered the tribunal and parties an objective, evidence-based quantification of the claimed damages and losses. His analysis played a central role in clarifying the quantum issues at the heart of the dispute, assisting the tribunal in its assessment, and ultimately supporting the resolution of the case.
