With the progressive development of international trade, transnational businesses, and economic globalization, litigators are increasingly confronted with cross-border legal issues. It is now commonplace to depose a foreign witness, translate discovery, prepare letters rogatory, manage parallel proceedings, have a multicultural jury, or collect assets overseas. To discuss the challenges facing litigators, the Association of Business Trial Lawyers assembled a panel of experts in Colorado Springs, Colorado from 1-4 October 2009. NERA Senior Vice President Dr. Alan Cox parricipated in a panel discussion entitled "Parallel Proceedings: Peering Into the Looking Glass?" Dr. Cox and his co-panelists discussed a range of topics, including the role of US courts on the world stage; forum non conveniens, comity, differences in economic analysis of liability and damages, and jurisdictional privileges; "independent" judicial experts in foreign proceedings; and anti-suit injunctions and stays. Other members of the panel included the Honorable M. Margaret McKeown and the Honorable James V. Selna.
