In December 2016, a U.S. federal court ruled that the amount of compensation for damages that Samsung paid to Apple should be reduced. This signified that the amount of damages for patent infringement should only take into account the gains associated with the patent in question, necessitating a quantitative assessment to determine the patent-related portion of the product and the contribution of the patent to sales.

The seminar focused on the issue of calculating the amount of compensation for damages in intellectual property disputes. In particular, there was a focus on the issue of the contribution-to-sales ratio, which can often prove a point of contention in Japanese courts, and Japanese court precedents and hypothetical case studies were also touched on, with a detailed explanation given on how to prove the amount of compensation for damages by using economic analysis and consumer questionnaires.

2016年12月には米国連邦裁判所がサムスンがアップルに支払った損害賠償額の減額を認める判断を示しました。これは特許侵害の損害賠償額は当該特許に関連する利益のみを考慮すべきであり、製品に占める特許の関連部分の割出しや特許による売上への貢献を定量的に評価する必要があることを意味しました。

本セミナーでは、知財紛争における損害賠償額算定の問題を取り上げました。特にわが国の裁判では争点になりやすい寄与率の問題に着目し、わが国の裁判例や仮想事例にふれながら、経済分析や需要者アンケートを用いた損害賠償額の立証方法について詳しく解説しました。
