On 3 December, Senior Managing Director Vinita Juneja will participate in a session at Washington Arbitration Week 2024 titled “Causation in ISDS Arbitration: What Is the Proper Causation Inquiry Under International Law? What Must a Claimant Prove in Terms of Liability and Damages?”. The panel will explore various interpretations of causation in international law, particularly within the context of Investor-State Dispute Settlement (ISDS). Dr. Juneja will focus on how a financial economist examines causation using different approaches including regression analysis and event studies. She will also address the implications for assessments of quantum, based on what can be shown about causation. Squire Patton Boggs Partner Chip Rosenberg will moderate the panel. 

In a separate session on 4 December, Senior Managing Director Julie M. Carey will participate in the “Workshop for Counsel and Arbitrators on Quantum and Cross Examination of Damages Experts: How to Conduct an Effective Cross-Examination.” The interactive expert witness cross-examination training session will provide a unique opportunity for lawyers to practice cross-examination of a quantum expert based on a mock investment arbitration case. The course aims to provide lawyers with the opportunity to cross-examine a quantum expert in front of a panel of experienced arbitrators, who will provide feedback to the teams. The session offers an opportunity for lawyers to enhance their skills and confidence in cross-examining quantum experts and to network with peers and experts in the field of international arbitration.
