Crucial Economic Considerations in Article 102 Cases

On 9 August, Associate Director Adrien Cervera-Jackson will present on the use of economics to analyse competitive effects in abuse of dominance cases under Article 102 at the EU Competition Law Summer School.
Mr. Cervera-Jackson’s presentation has two parts. The first will be a presentation on crucial economic considerations in Article 102 cases and the second will be a mock trial hearing on Article 102 issues and potential practical challenges that may arise during such cases.
More specifically, the presentation will explore:
- The rationale for effects-based enforcement;
- The European Commission enforcement guidelines, including key economic principles and concepts;
- A review of illustrious cases;
- The as-efficient competitor test;
- Exploitative abuses in pharmaceuticals; and
- Finding workable compliance principles.
The second session will provide a deeper understanding of crucial Article 102 issues by building on these topics through a hypothetical case.
