Non-Compete Agreements: Might They Be Procompetitive in Health Care?

Associate Director Dr. Paul Wong, Senior Consultant Dr. Emily Walden, and former Consultant Dr. Yun Ling are published in CPI’s May 2020 edition of the Antitrust Chronicle. In their article, Dr. Wong, Dr. Walden, and Dr. Ling examine the procompetitive justifications and limitations of non-compete agreements in the health care industry, concluding that bans on non-compete agreements risk discouraging investment and furthering problems in many health care settings that are already facing shortages. The authors urge a more comprehensive view of non-compete agreements that includes consideration of the investments they help facilitate.
